The Clinic for the Rights of the Arab-Palestinian Minority

 

The Clinic was established in 2007 by Advocate Durgham Saif, Dr. Yousef Jabareen and Dr. Ilan Saban. After running its program three times in succession it broke up for a spell to resume activities in 2013. It is now directed by Dr. Ilan Saban 
 
The Clinic's mission is to explore major legal issues related to the national schism in Israeli society, in a professional and academic capacity. This is realized through assisting human rights organizations in legal correspondence and litigation, classroom debates and research papers.
 
In class and team-work we hold open debates in which we seek a genuine in-depth polylogue through the individual input of each participant. The focus of discussion is legal-academic. We wish to understand the double role of the Israeli legal system, reflecting as it does public policy vis a vis the Arab-Palestinian minority (and the occasional shifts thereof) and at the same time holding the potential to be a leverage for social change.
  
The Clinic functions on the basis of existing disagreements without either evading the issues at stake or pretending consensus where it does not exist. So, for example, the Jewish and Arab citizens of Israel differ in their view of the preferable national identity of the State. Hence the Clinic functions within a shared middle-ground on the margins of this contention, namely in instances of exclusion and discrimination unacceptable even under the definition of Israel as a "Jewish and Democratic State".
 
This is the basis for selection of cases in which the Clinic assists organizations such as Adalah – the Legal Center for Arab Minority Rights in Israel or ACRI -- the Association for Civil Rights in Israel.
Among others, we are involved in cases to do with unrecognized villages, discrimination in education and the labor market, instances of profiling and stigmatization, classified evidence, potentially harmful legislation and people with special needs in the Palestinian Arab community.
